Terms and Conditions
Please note by paying the initial session fee you are agreeing to the terms and conditions outlined below:
Session fee: A session fee is required to make a booking; this secures the time & date. Session fees are non-refundable. Session fee prices can be found on my price list. By paying the session fee you are agreeing to the terms & conditions outlined in this document.
Payment: Payment of all packages and products must be paid in full before the final products are received by the client.
Image Files: All photographic image files remain the property of Rachel Humphrey Photography at all times. All original digital files presented to the client are retained by Rachel Humphrey Photography for a minimum of 6 months.
Copyright: English copyright law states that the copyright of photographs remains with the photographer.
No Commercial On-Sale: Rachel Humphrey Photography shall not make any commercial sale of the images without the written permission of the Client.
Client’s Usage and Reproduction: All prints and image files provided to the Client by Rachel Humphrey Photography are licensed for personal use only, and cannot be used for profit or advertising without written consent. Any posting of images on the internet must be acknowledged as images taken by the Photographer.
Your Proof Gallery: Following your Photoshoot, we will prepare and make available a selection of proofs of the Photographs from your session (“Your Proofs Gallery”). You will receive your Proofs Gallery as an online gallery between 14 - 21 days after the Photoshoot date, but during busy periods this timeframe may be extended.
The number of Photographs in Your Proofs Gallery will vary from session to session. We will take into consideration your specific requests as regards the contents of Your Proofs Gallery, but we retain absolute discretion regarding which Photographs we include in Your Proofs Gallery (it is acknowledged that not all Photographs taken during the Photo Shoot will be included); and the application of any digital editing to any Photographs.
Requests you make for specific corrections to images, or re-editing of images, may attract additional costs. We also accommodate specialist or bespoke requests for retouching of Photographs at additional cost. We may need to refer certain retouching services to our third party partners. We will advise you of the costs upon request. Please note that we do not provide raw images.
Viewing Your Proofs From an Online Gallery: Your Proofs Gallery will be presented as an online gallery comprising low resolution web-sized watermarked files. We will advise you by email when Your Proofs Gallery is ready for you to view. Your Proofs Gallery will be available for 5 days from the date of the email. Unless otherwise agreed by the Photographer, you must make your selection of Photographs, Package and any Artwork Products within this availability period. We reserve the right (at our option) to charge a fee for extending the availability of Your Proofs Gallery, or to delete Your Proofs Gallery and all Photographs if you do not place an order and pay the part of the Package Fee due at the time of placing the order during that time.
Your Proofs Gallery may be subject to password-protection. Only you may access Your Proofs Gallery. You are solely responsible for maintaining the confidentiality of any password we provide and you may not disclose your password to any other person. You agree to accept responsibility for all activities that occur through use of your password by a third party.
You acknowledge that: (i) your access to and use of Your Proofs Gallery may be suspended during any unanticipated or unscheduled downtime or unavailability of any portion or all of our website, including as a result of power outages, system failures or other interruptions; and (ii) we are entitled, without any liability to you, to suspend access to any portion or all of Your Proofs Gallery and/or our website at any time (a) for scheduled downtime to permit us to conduct maintenance or make modifications to Your Proofs Gallery or our website; (b) in the event of a denial of service attack or other attack on our website and/or our servers or other event that we determine, in our sole discretion, creates a risk to you or to any of our other users; or (c) if it is necessary or prudent to do so for legal or regulatory reasons (collectively, “Service Interruptions”). Where practicable, we will endeavour to post updates on our website regarding any Service Interruption and resumption of service following any such suspension, but we are not liable for the manner in which we may do so or if we fail to do so and we shall have no liability whatsoever for any damage, liabilities, losses (including any loss of data or profits) or any other consequences that you may incur as a result of any Service Interruption.
Image altering: To preserve the integrity of our work the client agrees not to alter any original images provided by Rachel Humphrey Photography. If the client requires any further cropping, altering, black and white adjustments or Photoshop they will need to contact Rachel Humphrey Photography for permission or a quote for it to be done professionally. Screen shots are strictly prohibited and must not be displayed on social media unless it is the original copy of the image untouched or cropped.
Creative License: Images are edited at the Photographer’s discretion, and delivered digitals may not include all images shot. Rachel Humphrey Photography reserves the creative rights to edit and release only those images deemed creditable as professional in quality and within the photographer’s artistic standards. Once the images are released to the client, there shall be no refunds made at all.
Travel: Photo sessions are to take place within a 15-mile radius of MK43 8AT. Further locations can be accommodated for a travel fee, please contact me in this instance.
Attendance: In the unlikely event that Rachel Humphrey Photography is unable to attend your photo session due to unforeseen circumstances, Rachel Humphrey Photography reserves the right to reschedule the photo session to another agreed date.
Cancellation & Postponement: Once the Client has made a booking for a specific time and date, Rachel Humphrey Photography will not accept any other work from other clients for those times and dates. As a result, once a booking is made for a family session, occasion or event, if it is subsequently cancelled, the full session fee will still be charged to the client according to the following schedule. Rachel Humphrey Photography will, at their discretion, allow postponements due to unforeseen circumstances, inclement weather and family emergencies as long as the session is re-booked within a 30 day period.
Photography of minors: For subjects under the age of 18 at least one Parent or Guardian must be present at all times, and the Parent or Guardian must maintain a visual contact with the minor/s.
Use of own cameras: Please refrain from using your own cameras / video cameras / iPhones etc. during the photo session. Having more than one lens to look at is confusing and will detract from the quality of your images.
Physical activity: Photo sessions involve physical activity. This is undertaken at the client’s own risk.
Failure to cooperate: The Photographer is not responsible for lack of or no image captures if key individuals fail to appear or cooperate during photography sessions or for missed images due to details not revealed to the Photographer. Clients are responsible for taking care of children and making sure they cooperate while the portrait session is ongoing to ensure, everything happens in the provided time slot.
Gift Certificates: Gift certificates are non-refundable, can only be used once and cannot be exchanged for cash. Gift certificates are valid for one year from date of purchase. Certificates cannot be used in conjunction with any other vouchers or offers. The recipient must agree to the terms and conditions stated in this document and complete a booking form prior to the photo session.
Miscellany: This Agreement incorporates the entire understanding of the parties. Any modifications of this Agreement must be in writing and signed by both parties. This Agreement shall be governed by the laws of the United Kingdom.
